TERMS AND CONDITIONS

1. SERVICES:

808 Photographers agrees to provide photography services as specified in the attached service proposal. The scope of services, including the date, time, and location of the photo session, will be detailed in the booking confirmation.

2. PAYMENT:

Client agrees to pay the total fee outlined in the service proposal. A non-refundable deposit of 50% is due upon booking, with the remaining balance payable on or before the date of the scheduled photo session.

3. RESCHEDULING AND CANCELLATION:

In the event that the Client needs to reschedule or cancel the photo session, a minimum of two days' notice is required. Failure to provide adequate notice may result in the forfeiture of the deposit.

4. PHOTO DELIVERY:

Photographs will be delivered to the Client within one week after the photo session date. The delivery method is via online gallery, 

5. COPYRIGHT AND USAGE:

808 Photographers retains the copyright to all photographs taken during the photo session. The Client is granted a non-exclusive license to use the photographs for personal purposes only. Commercial use requires written permission from 808 Photographers.

The Client agrees that 808 Photographers may use selected images for promotional purposes, including social media, unless otherwise notified in writing by the Client.

6. CAMERA AND CARD MALFUNCTION:

808 Photographers is not responsible for any camera or memory card malfunctions that may occur during the photo session. While precautions will be taken to prevent such malfunctions, the Client acknowledges that technical issues may arise. In the event of any malfunction, 808 Photographers will make reasonable efforts to recover and deliver as many images as possible, but shall not be held liable for any lost or unrecoverable images.

7. LIMITATION OF LIABILITY:

In no event shall 808 Photographers be liable for any indirect, incidental, special, or consequential damages arising out of or in any way connected with the services provided, even if 808 Photographers has been advised of the possibility of such damages.

The total liability of 808 Photographers shall not exceed the total amount paid by the Client for the services.

8. GOVERNING LAW:

This Agreement shall be governed by and construed in accordance with the laws of the State of Hawaii.

9. ENTIRE AGREEMENT:

This Agreement constitutes the entire understanding between 808 Photographers and the Client and supersedes all prior negotiations, understandings, and agreements, whether oral or written.

By booking our services, the Client acknowledges that they have read, understood, and agreed to these terms and conditions.

10.PHOTO SESSION: 

The details of the photo session, including date, time, and location, will be outlined in a separate agreement or proposal. The Client is responsible for arriving on time. Delays may result in a shortened session. Any specific requests, limitations or preferences must be communicated to 808 Photographers in advance.
