TERMS AND CONDITIONS

   1.    Services

808 Photographers agrees to provide photography services as outlined in the applicable booking confirmation, invoice, or service proposal. The scope of services, including date, time, duration, and location of the photo session, will be specified in the booking confirmation.

    2.    Payment

Client agrees to pay the total fee outlined in the booking confirmation or service proposal. A non-refundable deposit of 50% is required at the time of booking in order to secure the reservation. The remaining balance shall be due on or before the date of the scheduled photo session unless otherwise agreed in writing.

 

    3.    Service Fee and Gratuity

For the convenience of our clients, a 10% service fee and a 15% gratuity will be automatically added to the final invoice. These charges form part of the total booking amount and reflect the elevated level of service, coordination, and professional attention dedicated to your experience.

 

    4.    Rescheduling and Cancellation

A minimum of forty-eight (48) hours’ notice is required to reschedule or cancel a photo session.

    •    Cancellations made with more than 48 hours’ notice may apply the deposit toward a future rescheduled session, subject to availability.
   •    Cancellations made within 48 hours of the scheduled session will result in forfeiture of the deposit.
   •    Same-day cancellations or no-shows may be charged the full session amount at the discretion of 808 Photographers.

 

    5.    Late Arrival

Client is responsible for arriving on time to the scheduled session. Late arrivals may result in a shortened session duration without refund in order to preserve scheduling commitments.

 

    6.    Weather Policy

Outdoor photography sessions are subject to weather conditions. In the event of unsafe or unsuitable weather conditions, 808 Photographers reserves the right to reschedule the session at no additional charge, subject to availability. Weather-related rescheduling decisions shall be made at the sole discretion of 808 Photographers.

 

    7.    Photo Delivery

Final edited photographs will be delivered via online gallery within approximately one (1) week following the photo session unless otherwise specified. Delivery timelines may vary during peak seasons.

 

    8.    Artistic Discretion

Client acknowledges that 808 Photographers maintains full creative control over the artistic style, composition, editing, and final selection of delivered images. Editing and retouching decisions shall remain at the sole discretion of 808 Photographers.

 

    9.    Copyright and Usage

808 Photographers retains full copyright ownership of all images created during the photo session.

Client is granted a non-exclusive, non-transferable license to use the delivered photographs for personal, non-commercial purposes only. Commercial, editorial, promotional, or resale use of the images is prohibited unless prior written consent is obtained from 808 Photographers.

 

    10.    Promotional Use

Unless otherwise requested in writing prior to the session, Client grants 808 Photographers permission to use selected images for portfolio, website, social media, marketing, advertising, publication, and promotional purposes.

    11.    Equipment Malfunction / Force Majeure

808 Photographers shall not be held liable for circumstances beyond its reasonable control, including but not limited to equipment malfunction, memory card failure, acts of God, natural disasters, illness, accidents, government restrictions, or other force majeure events.

In the unlikely event of total photographic failure due to equipment malfunction or circumstances beyond reasonable control, liability shall be limited to a full refund of all amounts paid.

 

    12.    Limitation of Liability

808 Photographers shall not be liable for any indirect, incidental, consequential, or special damages arising from the services provided.

Under no circumstances shall liability exceed the total amount paid by Client for the services rendered.

 

    13.    Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Hawaiʻi.

 

    14.    Entire Agreement

These Terms and Conditions constitute the entire agreement between 808 Photographers and Client and supersede all prior discussions, negotiations, and understandings, whether oral or written.

 

    15.    Acceptance of Terms

By booking photography services with 808 Photographers, Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
